      Business Transfers: In the event of a merger, acquisition, asset sale, or a change in the management and operating contractor at the Nevada National Security Sites, your information may be transferred to the acquiring entity, to the United States Government, or to the successor management and operating contractor.

      Federal Privacy Laws and DOE Guidance

      The NNSS operates under specific federal privacy laws and DOE directives. The DOE’s Privacy Program, outlined in DOE O 206.1A, establishes requirements for implementing statutory and regulatory privacy obligations, especially those from the Privacy Act of 1974.  This includes safeguarding Personally Identifiable Information (PII) from unauthorized access or disclosure throughout its lifecycle.

      The Privacy Act of 1974 (5 U.S.C. §552a) regulates the collection, maintenance, use, and dissemination of personal information by federal agencies and their contractors.  It grants individuals rights to access and request corrections to records maintained about them.  Contractors maintaining systems of records on behalf of a federal agency are generally required to comply with the Privacy Act.  Records maintained by contractors as a result of their management discretion (e.g., their own personnel records) are typically exempt.  Any system of records that retrieves information concerning individuals by personal identifiers (e.g., name, Social Security Number) is subject to the Privacy Act.

      The DOE’s Chief Information Officer (CIO) is designated as the Senior Agency Official for Privacy Policy (SAOP) and is responsible for agency policy on privacy matters, ensuring compliance with federal laws, regulations, and policies, and providing privacy training. The NNSS also adheres to DOE O 206.1, which establishes Departmental implementation of agency statutory and regulatory requirements for privacy.

      The NNSS is also committed to complying with all applicable state privacy laws, including, but not limited to, the California Consumer Privacy Act (CCPA) as described below:

      Right to Know
      You have a right to submit a verifiable request for copies of your Personal Information that the NNSS has held over the past 12 months, free of charge, including:

      • The categories of Personal Information that we have collected.
      • The categories of sources from which we collected Personal Information.
      • The business or commercial purpose for collecting, selling, or sharing Personal Information.
      • The categories of third parties to whom we disclose Personal Information.
      • The specific pieces of Personal Information we have collected.

        Right to deletion
        At your request, we will delete your Personal Information unless we need to keep such information for legal purposes and/or to provide services or further the relationship with us that you have requested, including, but not limited to, your role as an employee or other employment or business relationship.

        Right to opt out of sale or sharing
        Subject to certain business and legal exceptions, you may request that we stop selling or sharing your Personal Information for cross-context behavioraladvertising.  However, note that the NNSS does not sell nor disclose Personal Information for cross-context behavioral advertising.

        Right to correct
        We will use commercially reasonable efforts to comply with your request to correct any inaccurate Personal Information.

        Right to limit the use and disclosure of Sensitive Personal Information
        Subject to certain business and legal exceptions, you may request that we limit the use and disclosure of Sensitive Personal Information.

        Right to data portability
        At your request, and subject to certain exceptions, we will provide you free of charge with any of your Personal Information that we hold to the extent required by law, and will provide it in a structured, commonly used and machine-readable format.

        Right to nondiscrimination
        You are entitled to exercise the rights described above free from discriminatory treatment prohibited by the CCPA.

        Data Security

        The NNSS implements appropriate administrative, technical, and physical safeguards to protect the confidentiality, integrity, and availability of information it collects and maintains. These measures are designed to prevent unauthorized access, disclosure, alteration, or destruction of information. Our cybersecurity program aligns with DOE O 205.1, which establishes policy for incident response and reporting requirements for events impacting DOE information systems.[4]

        Children’s Privacy (Interaction with Children)

        The NNSS website may provide educational content that is accessible to children under the age of 13. The NNSS does not intentionally collect personal information from children under 13 unless it is voluntarily submitted by the user (or parent/guardian) to request information or specific services. Any information submitted in this manner is used solely to respond to the inquiry or fulfill the requested service.

        The NNSS website may contain links to external websites not operated by the NNSS. This Privacy Policy does not apply to those third-party sites. We encourage you to review the privacy policies of any external sites you visit.
